Terms of Service

1. Acceptance

Using atomwords.com means you agree to these Terms, the Privacy Policy, and the License. They form a binding contract between you and AtomWords ("we"), an independent project run by an individual operator based in mainland China. Reach us any time at support@atomwords.com. AtomWords is free to browse; paid unlock packs open production-ready collections (§3a and the Refund Policy). There are no subscriptions. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.

2. Eligibility

You must be 16 or older (or your jurisdiction's digital-consent age, whichever is higher). To buy an unlock pack you must be able to enter a binding contract where you live — an adult, or a minor buying with a parent or guardian's permission.

3. The Service

AtomWords is an AI visual dictionary — curated atomic prompt words and sample media generated using third-party AI services. The dictionary is free: browsing, searching, copying prompts, and downloading its sample media. Paid collections are shown as watermarked previews; an unlock pack opens their watermark-free reference images and full prompts. All digital — no shipping.

3a. Packs and unlocks

• One-time, not a subscription. A pack is bought once. Nothing renews, nothing is charged again.

• Paddle is the Merchant of Record. Paddle takes the payment, applies tax, issues the receipt, and processes refunds. Prices are shown in USD before tax; Paddle adds tax where applicable and may charge the equivalent in your local currency.

• Delivery is immediate. Unlocks are usable the moment payment completes. By purchasing you consent to immediate delivery of digital content and acknowledge that once you start using an unlocked collection, the statutory 14-day withdrawal right (EU / EEA / UK) no longer applies — see the Refund Policy, which also states what we refund regardless.

• An unlock is permanent for the collection you spend it on, for as long as the purchase stands. The all-access pass covers every collection, including ones published later.

• Unlocks are personal. They belong to your account, can't be transferred or exchanged for cash, and are forfeited if you delete your account.

• Gift unlocks we issue to an account are free, personal, and not refundable.

• Refunds and chargebacks follow the Refund Policy: a refunded pack's collections lock again.

• We may change pack prices or contents at any time; purchases already made are not affected.

4. Your account

You're responsible for your password and all activity under your account. Report unauthorized use to support@atomwords.com. We may suspend or terminate accounts engaged in abuse. You may delete your account anytime from /settings.

5. What you may not do

• Scrape, crawl, or systematically extract our prompts, commands, commentary, taxonomy, or media — for any purpose, including a competing dictionary or AI-model training.

• Resell, redistribute, or repackage our content (Gumroad, Etsy, Patreon, prompt marketplaces, your storefront, packs, etc.).

• Sell unaltered copies of our sample media as stock (Adobe Stock, Shutterstock, Getty, Pond5). You may sell media you generated using our prompts.

• Reverse engineer, interfere with, or attack the Service (DoS, brute-force, credential stuffing).

• Generate or distribute unlawful, infringing, defamatory, harassing, or deceptive content.

• Modify our prompts to add trademarks, brand names, or identifiable persons — you assume sole liability if you do.

We may investigate and act at our discretion — warning, suspension, termination, removal, or referral to law enforcement.

Fair use. Downloads are subject to reasonable per-account daily limits (shown in-app if you reach one, reset daily at 00:00 UTC) to keep the Service fast and prevent abuse. We may adjust limits or throttle / suspend accounts showing automated or abusive download patterns.

6. Ads and affiliate links

We may display native ads, sponsored content, and affiliate links, and may earn commission at no extra cost to you. We don't endorse or assume liability for third-party advertisers. External destinations are governed by their own terms.

7. Intellectual property

Our atomic words, commands, commentary, taxonomy, sample media, name, and logo are owned by us or licensed by upstream AI providers. Your use is governed by the License. Content you generate using our prompts belongs to you, subject to your AI service's terms. We claim no ownership of your outputs. Generative AI is probabilistic; despite our care, sample media may occasionally resemble copyrighted works — see §8.

7a. Your contributions ("User Content")

"User Content" means anything you upload or post to AtomWords — images, prompt text, notes, and any other material. Today that means community works: an image plus the full prompt behind it, contributed on an atom word.

You own your User Content. We claim no ownership of it, ever.

License you grant us. So we can run the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, transcode, and display your User Content on the Service, on our own social media accounts, and in materials that promote the Service. We may pass these same rights to our hosting and content-delivery providers, solely so they can store and serve your User Content as part of the Service — that is the only sublicense we take. This license goes no further: it does not include the right to sell your User Content or to license it to anyone else. Cached or resized copies may persist briefly after removal while deletions propagate.

Prompt text is meant to be used. By submitting a work you additionally grant us and every visitor a non-exclusive, royalty-free, irrevocable license to copy and use its prompt text, including commercially — that is what the Copy button does, and it is the point of contributing. Withdrawing a work ends the display of its prompt, but copies made before withdrawal remain licensed.

Your images are display-only. We show contributed images on the word's page, in the community feed, and in previews. We do not offer downloads of contributed images, and these Terms grant visitors no license to reuse them — all rights in a contributed image stay with its creator (see the License).

No fees, either way. Contributing is free and unpaid: we do not charge you to contribute, and we do not pay you for contributions or their use. Contributed content is never placed behind a paywall or sold as paid content.

What you promise. Each time you submit User Content you represent and warrant that: (a) you have all rights needed to share it and to grant the licenses above — including any rights required by the AI tools you used to create it; and (b) it does not infringe or misappropriate anyone's copyright, trademark, privacy, publicity, or other rights, and is not unlawful, deceptive, or defamatory. You are solely responsible for your User Content.

Withdrawal and moderation. You can withdraw a work at any time from your profile; we stop displaying it and delete the file. Every contribution is reviewed before it appears, and we may remove, decline, or block any User Content at any time, without notice, for any reason. We are under no obligation to monitor User Content and are not responsible for it.

Copyright complaints about User Content follow the process in §8, including the repeat-infringer rule.

8. Copyright

If content on AtomWords infringes a copyright or other IP right you own or are authorized to enforce, email copyright@atomwords.com — we follow a DMCA-style notice-and-takedown process. Include: the work + the infringing URL; your contact info; a good-faith statement the use is unauthorized; a statement of accuracy and your authority, under penalty of perjury; your signature. We investigate promptly and remove valid claims. Counter-notices to the same address. Accounts with repeated substantiated infringements (two or more) will be terminated.

9. Disclaimer & liability cap

The Service is provided "as is" and "as available," without warranty of any kind (merchantability, fitness, non-infringement, accuracy, uninterrupted operation). We don't warrant any prompt's accuracy, the outputs your usage produces in any AI service, or any upstream service's future behavior.

Liability cap. To the maximum extent permitted by law, our total cumulative liability will not exceed the greater of USD 50 and the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, consequential, lost-profit, or lost-data damages. Where law forbids these limits, our liability is the minimum that law requires. You indemnify us against claims from your violation of these Terms or misuse of our content — especially §5's protected-names rule.

10. Termination

You may terminate by deleting your account. Deleting it forfeits any unspent unlocks and all-access — request any refund through Paddle first. We may suspend or terminate accounts that violate these Terms, where required by law, or to protect the Service. Sections 3a, 5, 7, 7a, 8, 9 survive.

11. Governing law

Governed by the laws of the People's Republic of China (excluding HK, Macau, Taiwan), without conflict-of-law principles. Nothing here removes the mandatory consumer-protection rights you have where you live (EU / UK / EEA / Switzerland, etc.). Any claim must be brought within 1 year, unless mandatory law requires longer.

12. General

These Terms + Privacy + License are the entire agreement. If a provision is unenforceable, the rest stands. Non-enforcement is not waiver. You can't assign without our consent; we may, in a transfer of the Service. Material changes get 30 days' notice. English controls in any translation conflict.
